Terms and Conditions for Luma

1. Acceptance of Terms

By downloading, installing, or using Luma (“App”), you agree to be bound by these Terms and Conditions. If you do not agree with these terms, do not use the App.

2. App Description

Luma is a health application designed to help users monitor and reduce alcohol consumption through personalised plans, tracking tools, and AI coaching.

3. Account Registration

3.1 Account Creation

To use the App, you must create an account with a valid email address and secure password

 

3.2 Account Responsibility

You are responsible for:
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and up-to-date information

 

3.3. iCloud Requirements

The App uses Apple’s iCloud service to store and sync your personal data. Your data is stored in your personal iCloud account, not on our servers. You accept that:
  • You must have iCloud enabled on your device for full functionality.
  • If iCloud is disabled, you may lose data when switching devices.

4. Health Disclaimer

4.1 Not a Medical Device or Medical Advice

IMPORTANT: Luma is not a medical device and does not provide medical advice, diagnosis, or treatment. The app is designed as a digital wellness tool to support personal goal-setting and habit tracking related to alcohol consumption.

  • Are for informational and educational purposes only
  • Are not a substitute for professional medical advice
  • Should not be used to diagnose or treat alcohol use disorders
  • Are not intended to replace consultation with qualified healthcare professionals

4.2 When to Seek Professional Help

You should consult with a healthcare professional if you:

  • Experience withdrawal symptoms when reducing alcohol consumption
  • Have concerns about alcohol dependency or addiction
  • Have underlying health conditions that may be affected by alcohol consumption
  • Are taking medications that may interact with alcohol
  • Experience any adverse physical or mental health effects

4.3 Emergency Situations

This app is not designed for emergency situations. If you experience a medical emergency, including severe withdrawal symptoms, call emergency services immediately (999 in the UK, 112 in the EU).

 

4.4 User Responsibility

By using this app, you acknowledge that:

  • You are responsible for your own health and safety
  • You will seek professional medical advice when appropriate
  • You understand the limitations of this digital wellness tool
  • You will not rely solely on this app for health-related decisions

5. AI Coaching Feature

5.1 Nature of AI Coaching

The AI coach provides automated guidance based on the information you provide. It:

  • Is not a replacement for professional healthcare
  • May not address your specific circumstances
  • Uses artificial intelligence that can make mistakes

5.2 User Responsibility

You should:

  • Use critical judgment when reviewing AI suggestions
  • Not rely solely on AI coaching for health decisions
  • Report inappropriate or concerning AI responses

6. Data Storage and User Responsibilities

6.1 iCloud Data Storage

Your personal health data is stored in your iCloud account using Apple’s CloudKit service.

  • We do not have access to this data – it belongs to you
  • You are responsible for maintaining your iCloud account and Apple ID security.
  • You must keep iCloud enabled to maintain data sync across devices

    6.2 Data Loss Limitations

    If you disable iCloud or lose access to your Apple ID, you may lose your data.

    • We cannot recover data stored in your iCloud account
    • We recommend keeping iCloud enabled and your Apple ID secure
    • Local device storage alone may result in data loss when switching devices

     

     

     

      6.3 Account Deletion

      You can delete your account at any time through the App settings.

      • Account deletion will remove your data from both our servers and your iCloud account
      • This action is permanent and cannot be undone
      • Deleted data cannot be recovered.

        7. Subscription Terms

        7.1 Free Trial

        We may offer a free trial period. After this period, continued use requires subscription payment.

         

        7.2 Subscription Billing

        Payments are processed through Apple’s App Store payment system

        – Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

        • Your account will be charged for renewal within 24 hours prior to the end of the current period
        • Pricing will be clearly displayed before purchase
        • No refunds will be provided for unused portions of subscription periods

         

        7.3 Cancellation

        You can manage and cancel subscriptions through your Apple App Store account settings.

        8. User Conduct

        You agree not to:

        • Violate any applicable laws
        • Impersonate others or provide false information
        • Use the App to harm others
        • Attempt to gain unauthorised access to the App
        • Interfere with the proper functioning of the App
        • Reverse engineer or attempt to extract the source code

        9. Intellectual Property

        All content, features, and functionality of the App are owned by Bighouse Ventures Ltd and are protected by copyright, trademark, and other intellectual property laws.

        10. Limitation of Liability

        10.1 General Limitation

        To the maximum extent permitted by law, Bighouse Ventures Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the App.

         

        10.2 iCloud Service Limitation

        We are not responsible for any data loss or issues arising from the use of Apple’s iCloud service. You acknowledge that your data is stored in your personal iCloud account and that you are responsible for maintaining access to it.

         

        11. Termination

        We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

         

        12. Changes to Terms

        We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

        13. Governing Law

        These Terms shall be governed by the laws of United Kingdom, without regard to its conflict of law provisions.
